We are committed to providing high-quality instruments and a seamless hire experience. The following terms ensure clarity and fairness for both parties.
To help you get the most out of your hire, this document explains how the process works, from booking and payment through to delivery, use, and what happens if anything goes wrong. It's designed to be straightforward and easy to reference.
1. General
1.1 This contract defines the terms and conditions under which all hires, delivery and collection of percussion instruments from SN Percussion Ltd are made.
1.2 All instruments and accessories remain the property of SN Percussion Ltd at all times.
1.3 This contract is personal to the hirer and may not be assigned or transferred without written consent from SN Percussion Ltd.
2. Contract
2.1 You may place your hire order with us by e-mail, telephone or in person.
2.2 We will provide you with an order quote confirming availability of the instruments requested and stating total costs including delivery and or collection as required. We will also provide you with this set of terms and conditions.
2.3 There will be an additional charge for hire orders received less than 48 hours before the commencement of the hire.
2.4 The contract between us will be formed when you advise us that you accept the order quote, providing the instruments are still available.
2.5 The hire contract starts when the instruments are collected by the hirer or when delivered to the venue as may be arranged.
2.6 For the purposes of this agreement, a hire period is based on a calendar day (midnight to midnight), not a 24-hour period from the time of delivery or collection.
2.7 The hire contract terminates when the instruments are returned to us, or have been collected by us as arranged, and are found to have been returned in their original condition.
2.8 You agree to reimburse us for all costs in connection with cleaning, repairing or replacing instruments not returned in clean and good working condition, and will be liable for charges at the daily rate shown in the order quote for the period of such repair or replacement.
2.9 We reserve the right to terminate the contract and repossess any hired instruments if the hirer breaches the agreement or enters insolvency or liquidation. This does not affect our right to claim damages or unpaid hire charges.
2.10 We reserve the right to decline a hire request at our discretion, including concerns regarding security, risk, or previous non-compliance.
3. Hire Charges
3.1 Our hire charges will be as shown in the order quote and invoice together with the date the charges will commence and the period of the hire.
3.2 Additional charges may be incurred by the hirer, should circumstances of the hire change during the hire period.
3.3 Transportation charges are in addition to hire charges, and these will be listed separately in both the quote and invoice if this service is required. We reserve the right to charge additional fees if alterations are made to the original arrangements.
3.4 Where instruments are not returned on the agreed date and no extension has been authorised in writing, the hirer will be charged the full daily hire rate for each day the instruments are overdue, and until they are returned or replaced. Please note that the agreed return date forms a critical part of the hire schedule and must be adhered to.
4. Payment
4.1 We will request payment in full prior to delivery, or at our discretion within 7 days of delivery. The precise structure of payment will be specified in the order quote.
4.2 Payment may be made by cash, cheque, BACS transfer or PayPal.
4.3 Where any payment is not made by the date specified in the order quote we shall be entitled to charge an additional fee for late payment.
4.4 The hirer agrees to notify SN Percussion Ltd immediately of any changes to contact details, address, or payment information relevant to the hire agreement.
5. Delivery
5.1 We only deliver to customers in the mainland of the United Kingdom, and all the instruments must be signed for by a person aged 18 or over.
5.2 The instruments will be delivered in good working order. Unless notice is received to the contrary as soon as is reasonably practicable and in any event no later than within 24 hours of delivery, instruments will be deemed to be in good working order, except for defects not detectable by reasonable examination. Where possible, any damage reported should be supported with photographic evidence.
5.3 Our estimated time for delivery, where applicable, will be agreed with you. Occasionally delays will occur, despite our best efforts. We will not be liable for any delay or failure to deliver within such estimated timescales.
5.4 The hirer is responsible for ensuring safe and reasonable access to the venue for delivery and collection. Additional charges may apply if unexpected delays or obstructions occur.
6. Cancellation
6.1 You will not be entitled to cancel the contract once the instruments have been uplifted by the hirer or delivered by us, unless we agree to such cancellation.
6.2 If you wish to cancel the contract more than 48 hours before the commencement of the hire, we will refund any payment already made.
6.3 If you wish to cancel the contract within 48 hours of the commencement of the hire, the following cancellation charges will apply (being a percentage of the hire charge excluding transportation charges where applicable):
In the period of 48 hours to 24 hours before the commencement of the hire period – 50% of hire charge
Less than 24 hours before the commencement of hire period – 100% of hire charge
7. Care, Use, and Responsibility for Hired Instruments - Transport and Collection
7.1 If uplifting the instruments directly from us, the hirer must ensure they have suitable transport that allows for the safe, secure, and lawful transit of the instruments. We reserve the right to refuse the release of any items where appropriate arrangements have not been made. All hire instruments must have foot brakes engaged (where fitted) and must be secured within the vehicle to minimise movement during transit. Instruments transported in the hirer’s vehicle are entirely at the hirer’s risk.
7.2 The hirer will be responsible for the insurance and security of the instruments. The hirer agrees not to leave the instruments unattended in any vehicle.
Security and Insurance
7.3 The hirer is responsible for the safe and correct use of the instruments whilst on hire to them. The hirer will immediately notify SN Percussion Ltd of any damage or faults to the instruments by phone call or email. Where possible, please include photographic evidence.
7.4 The hirer accepts responsibility for any damage to the instruments that occurs whilst in the hirer's possession and will reimburse SN Percussion Ltd for any costs associated with repairing any instruments not returned in good condition or will pay us the full new retail cost of any instrument which is lost, stolen or damaged beyond economic repair.
7.5 In the event of loss or theft, the hirer must notify SN Percussion Ltd immediately and report the incident to the police, obtaining an incident or crime number. The hirer will be responsible for the full replacement cost of the instrument(s). Failure to report the incident or provide a crime reference may result in additional liability.
Loss, Theft and Damage
7.6 You agree to pay the full daily rate for all instruments which require to be replaced or repaired until such repair or replacement has been completed.
7.7 Instruments must not be used outdoors unless agreed in writing. If used outdoors, the hirer is responsible for ensuring they are protected from rain, moisture, and extreme weather.
Use and Handling
7.8 Instruments should only be used by appropriately trained or supervised individuals. SN Percussion Ltd accepts no responsibility for injuries caused by misuse or improper handling.
7.9 We recommend that the hirer ensures adequate insurance cover is in place for the instruments during the hire period. Proof of insurance may be requested for high-value hires.
7.10 The hirer must not undertake any repair or modification to the instruments without prior written consent from SN Percussion Ltd. Repairs carried out by unauthorised persons may result in additional charges or replacement costs.
Repairs and Consumables
7.11 Consumable accessories such as drumsticks, beaters, mallets, and spare heads are not included in the hire unless explicitly stated in the order quote. It is the
responsibility of the hirer to provide or purchase separately.
8. Publicity
8.1. Unless otherwise notified in writing, we reserve the right to publicise on digital platforms, any events featuring our instruments.
9. Liability and Indemnity
9.1 To the fullest extent permissible under law, we will not be liable for any losses you incur arising out of or in connection with the hire of the instruments.
9.2 You agree to always indemnify us in respect of all claims by any person in relation to any injury, loss, claim or expense arising out of or in connection with the use of the instruments.
10. Force Majeure
10.1 SN Percussion Ltd shall not be liable for any delay or failure to perform our obligations where such delay or failure is due to events beyond our reasonable control, including but not limited to natural disasters, extreme weather, transport strikes, or illness.
11. Jurisdiction
This contract shall be governed and construed in accordance with the laws of Scotland, and the courts of Scotland shall have exclusive jurisdiction to settle any dispute arising out of or in connection with this Contract.
